1. Acceptance of Terms

Welcome to Fable's Adventures! By accessing or using our mobile application ("App"), website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Mundell Designs, LLC ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Services after any changes indicates your acceptance of the new Terms.

2. Description of Service

Fable's Adventures is an AI-powered storytelling application that allows users to create personalized audiobook adventures. Our Services include:

• Story generation using artificial intelligence technology
• Text-to-speech audio narration with various voice options
• Character illustration generation
• Story library management and storage
• Story sharing capabilities

3. User Accounts and Registration

Account Creation: To access certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Age Restrictions: The Services are intended for users who are at least 13 years of age. Users under 18 must have parental or guardian consent to use the Services. Parents and guardians are responsible for monitoring their children's use of the App.

4. Subscription and Payment Terms

Token System: Our Services operate on a token-based system. Tokens are required to create stories, generate audio, and access premium features.

Free Tier: New users receive an initial token allocation to explore the Services. Additional tokens may be earned through achievements and promotional activities.

Paid Subscriptions: We offer various subscription plans that provide monthly token allocations and access to premium features, including our full library of voice options. Subscription fees are billed on a recurring basis according to your selected plan.

Token Purchases: Tokens may be purchased in bundles as one-time transactions. All token purchases are final and non-refundable except as required by applicable law.

Payment Processing: All payments are processed through Apple's App Store or other designated payment platforms. You agree to the payment terms and policies of these platforms.

Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You may cancel your subscription through your App Store account settings.

Refunds: We generally do not provide refunds for subscription fees or token purchases. However, we may consider refund requests on a case-by-case basis for extenuating circumstances.

5. User Content and Intellectual Property

Your Content: You retain ownership of any content you create using the Services, including story text, character names, and customizations ("User Content").

License Grant: By creating and sharing stories through our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, store, and display your User Content solely for the purpose of providing and improving the Services.

Content Standards: You agree not to create or share content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Contains hate speech, discriminatory content, or promotes violence
• Infringes on any intellectual property rights of others
• Contains sexually explicit or inappropriate material, especially involving minors
• Violates any applicable laws or regulations

AI-Generated Content: Stories created using our AI technology are generated based on your inputs and prompts. While you have creative input, the underlying AI models and technology remain our property.

Content Moderation: We reserve the right to review, monitor, and remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

Children's Privacy: We take special care to protect the privacy of children. We do not knowingly collect personal information from children under 13 without verifiable parental consent.

7. Prohibited Uses

You agree not to use the Services to:

• Violate any applicable laws or regulations
• Infringe on the rights of others, including intellectual property rights
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or networks
• Reverse engineer, decompile, or disassemble any aspect of the Services
• Use automated systems or software to extract data from the Services
• Impersonate any person or entity or misrepresent your affiliation

8. Third-Party Services and Links

Our Services may contain links to third-party websites or services, including our story sharing platform at stories.fablesadventures.com. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

9. Disclaimers and Limitation of Liability

Service "As Is": THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantee: We do not guarantee that:

• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Services will be accurate or reliable
• Any errors in the Services will be corrected
• AI-generated content will meet your expectations or requirements

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUNDELL DESIGNS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Maximum Liability: Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mundell Designs, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your User Content
• Your violation of any rights of another person or entity

11. Termination

Termination by You: You may stop using the Services at any time. You may delete your account through the App settings.

Termination by Us: We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

Effect of Termination: Upon termination:

• Your right to use the Services will immediately cease
• We may delete your account and User Content
• Unused tokens and remaining subscription time will be forfeited
• Provisions of these Terms that by their nature should survive termination shall survive

12. Charitable Commitment

Mundell Designs, LLC is committed to supporting people living with ALS (Amyotrophic Lateral Sclerosis). A portion of proceeds from Fable's Adventures is donated to the Live Like Lou Foundation. While we are proud of this commitment, it does not create any obligation or warranty regarding the Services, and we reserve the right to modify or discontinue this charitable program at any time.

13. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law provisions.

Arbitration: Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. The arbitration shall take place in Pennsylvania.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the fullest extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or other equitable relief.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date at the top of this document
• Sending a notification through the App (for significant changes)

Your continued use of the Services after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services.

15. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mundell Designs, LLC regarding the Services.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

No Agency: These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.
